This Agreement becomes effective on the date you first access or use the fastrealease application or related materials.3. Software License
fastrealease is provided under a one-time purchase license that grants you non-exclusive, non-transferable, and perpetual access to the Software and its features. The Software is intended for independent creators, entrepreneurs, and small businesses to build websites and online portfolios. No recurring fees or subscriptions apply unless explicitly stated. fastrealease reserves the right to terminate or revoke access to the Software at any time, without prior notice, if required for legal, security, or operational reasons. Upon termination, your right to use the Software ends immediately. This does not affect any statutory consumer rights under applicable EU law.
4. Refund Policy
Due to the digital nature of the Software and the immediate access provided after purchase, refunds or exchanges are excluded once access has been granted, in accordance with Article 16(m) of Directive 2011/83/EU. By purchasing fastrealease, you expressly agree that the right of withdrawal expires once access to the digital content is provided.5. Disclaimer
The Software is provided on an “as is” and “as available” basis. fastrealease does not guarantee that the Software will meet your requirements, be uninterrupted, secure, or error-free. To the maximum extent permitted by applicable EU law, all express or implied warranties are excluded, except where such exclusion is not legally permitted. Nothing in this Agreement limits mandatory consumer protection rights under EU law.6. Limitation of Liability
To the maximum extent permitted by applicable law, fastrealease shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of profits, data, business opportunities, or goodwill. fastrealease’s total liability arising out of or in connection with this Agreement shall not exceed the amount paid by you for the Software. This limitation does not apply to liability resulting from: Intent or gross negligence Personal injury or death Mandatory statutory liability under EU law7. User Responsibility
You are solely responsible for any content you create, upload, or distribute using fastrealease. fastrealease does not monitor or control user-generated content and assumes no responsibility for it. You agree to comply with all applicable laws, including intellectual property and data protection regulations.8. Data Protection & GDPR
fastrealease processes personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (GDPR). Personal data is processed only to the extent necessary for: Providing and maintaining the Service Processing payments Customer support Legal compliance Details regarding data processing, retention, and your rights (including access, rectification, erasure, and data portability) are described in the Privacy Policy, which forms an integral part of these Terms.9. Pricing
Prices may change over time as fastrealease evolves and new features are introduced. Any price changes will not affect purchases already completed. Discounts or early-access pricing are offered to allow customers to secure current pricing before future increases.
10. Governing Law and Jurisdiction
This Agreement is governed by the laws of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer residing in the EU, you may also benefit from mandatory consumer protection provisions of your country of residence.
11. No Partnership
Nothing in this Agreement creates a partnership, joint venture, employment, or agency relationship between you and fastrelease. You may not represent yourself as acting on behalf of fastrealease.
